The Choral Calculator is a virtual tool that operates without the need for real-time intervention by the owner. If you require human support regarding the Calculator functionalities, please send an email using the address registered to your account. Other email addresses will not be recognized as the owner of your account.

The Choral Calculator offers the following features:

– Registration of choirs and works, storage of registrations, and sending copies to the account holder’s email.

– Calculation based on the choir-work relation, resulting in vocal range alerts, rehearsal demand estimation, average difficulty level, and presumed feasibility.

– Deletion of data for choirs, works, and performed calculations.

Rules of Conduct

  1. Each user account is personal and non-transferable. Sharing accounts or access credentials is prohibited. This is absolutely necessary to ensure data security and privacy.
  2. The application must be used exclusively for registering choirs and works and performing calculations initiated by and for the end-user. Use in commercial contexts or for third parties outside this scope is prohibited or requires express permission from the owner of the Choral Calculator.
  3. Users must register only choirs which they work with directly and are entirely responsible for entering data for any choirs. Users must have authorization to register and share choir information.
  4. Any sharing of data from choirs registered by the user must respect the privacy of the choirs. Users are solely responsible for any misuse or privacy violations related to data which they share.
  5. The use of data registered in the Choral Calculator or provided by it must comply with the application Privacy Policy, which is based on data protection laws such as the LGPD, GDPR, and CCPA.
  6. Users must access the Choral Calculator exclusively through its official interface.
  7. Contact via email or any other communication tools provided in the application must be used only for issues relevant to the use of the Choral Calculator.
  8. Special terms may apply for using the Choral Calculator in educational or academic contexts, both for classes and research. Interested users should contact us via email for more information.

Misuse

  1. Using illegal or unauthorized means to access other users’ accounts or restricted areas of the application, violating data security and privacy. Using other users’ credentials without permission is strictly prohibited.
  2. Selling, sharing, or distributing data registered in the Choral Calculator to third parties without express authorization, contrary to privacy principles and the application purpose.
  3. Sending spam, phishing, advertising messages, or other inappropriate communications to the Choral Calculator contact channels.
  4. Using bots, scripts, or other automated methods to interact with the application without using the standard interface, which may overload the system, compromise security, and cause data processing issues. Abuse of automated resources is subject to sanctions.
  5. Attempting to exploit or test vulnerabilities in the system, whether through code injection, security exploits, or data breaches, compromising the application and users’ data security.
  6. Engaging in activities that impair the application functioning, such as intentionally overloading the system (e.g., triggering many calculations simultaneously).
  7. Integrating or linking the Choral Calculator to other websites, applications, or systems using APIs or any other method without prior and express authorization from the owner of the Calculator.
  8. Intermediating or facilitating third-party access to the Choral Calculator through other platforms, tools, or systems not officially offered by the Choral Calculator.

Intellectual Property

All documentation made available in the Choral Calculator, as well as the Calculator structure itself—including its interface—are protected by copyright and trademark laws. They cannot be reproduced in whole or in part or used for purposes other than those provided in these Terms and Conditions without the express authorization of the rights holders. Use of the Calculator is allowed exclusively through the official interface, and integration or incorporation into other websites, applications, or platforms is prohibited without express authorization. Any attempt to intermediate or use the Choral Calculator outside these terms will be considered a violation. Any violation of intellectual property rights may result in legal sanctions and account suspension.

Limitation of Liability

The Choral Calculator is a tool in the initial phase of availability and, although it provides consistent results internally, it may not accurately reflect the exact reality of the relation between a choir and a choral work, especially concerning the estimation of rehearsal demand. Users can safely use the results to guide their rehearsal and season planning, as well as repertoire selection, but cannot expect each work to be ready for public performance in the exact time predicted by the Calculator. Users must adjust their planning according to fluctuations in the actual conditions of rehearsals and are entirely and solely responsible for any damages resulting from poor planning. The Choral Calculator and its legal representatives are not responsible for decisions made based on the results provided by the application.

Changes to the Terms

The author and owner reserve the right to modify the Terms and Conditions or the Privacy Policy at any time as needed. If modifications occur, you will receive a visible notification, either on the website or via the email registered to your account. You will have 30 days to review and, if desired, decline the new terms. Failure to respond will be automatically understood as acceptance. If you do not agree with the new terms, you may request the deletion of your account and all your data by email at any time.

Applicable Law, Amicable Agreements, and Jurisdiction

These Terms of Use are governed and interpreted in accordance with the laws of the Federative Republic of Brazil, especially the provisions of the General Data Protection Law (Law No. 13,709/2018 – LGPD) and the Consumer Defense Code (Law No. 8,078/1990), without prejudice to the application of other international data protection laws, such as the General Data Protection Regulation (GDPR) of the European Union and the California Consumer Privacy Act (CCPA), when applicable.

In case of controversies or disputes arising from these Terms and Conditions or the use of the Choral Calculator application, the parties agree to first seek an amicable solution through direct negotiations by contacting each other via email. The parties agree to make their best efforts to resolve any disputes amicably within 30 days from the date of notification.

The court of the district of Juiz de Fora, State of Minas Gerais, Brazil, is designated for any matter that cannot be resolved through amicable agreement, with express waiver of any other jurisdiction, no matter how privileged it may be.
